Photograph copyright

Hi all
Statement :- If somebody takes a photo of something they get the copyright on that photograph.
Question :- If somebody prints off an image from the internet and takes a picture of it, or takes a picture with a camera of another photograph do they have the copyright because they have taken the picture or is the copyright still that of the original person.
Thanks
Merv

Not always but in most cases, yes.

Would be too simple. It depends on which picture, and how you take it. If the original pic is not under author's right, you can freely use the pic you made, however in the case you just take a simple pic of the pic, that won't give you any authorship on this pic. If the picture is under "copyright", a simple pic won't give you authorship and you cannot use it freely.

Also, it is important to note that "copyright" in an american context, is not the same as copyright in an british context which is to be understood as "author's right", regarding the european law. Two systems that are slighlty different.
Assuming its digital it would definitely count as an electronic reproduction. You are just copying it in a different way to using the copy and paste function. In order to claim authorship you need to significantly modify the image.
